Terms of Service

These Terms of Service ("Terms") govern your access to and use of pfcloud (the "Service"), operated by PFC Tek ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it, and "you" means that organisation.

1. The Service

pfcloud is a platform for setting up servers you control and deploying applications to them. The Service connects to your servers over SSH using keys you authorise, runs management scripts on them, and stores the settings, logs and backups needed to operate your sites.

You keep full ownership and control of your servers, code and data. We act on your servers only when you, a member of your team, an automation you configured (for example a deploy on push or a scheduled backup), or a safety feature you enabled tells us to.

2. Accounts and teams

  • You must give accurate information, keep your password and two-factor methods secure, and tell us promptly at myforge@steadyridedrivingschool.com if you suspect unauthorised access.
  • You must be at least 18 years old, or the age of majority where you live.
  • Team owners decide who joins their team and what each member may do. You are responsible for everything done through your account and your team, including through API tokens you create.
  • We may require two-factor authentication for accounts that manage servers.

3. Your servers and your responsibilities

  • You confirm you own each server you connect, or have the owner's permission to let pfcloud manage it.
  • You are responsible for your servers' hosting bills, the content you deploy, your domains and DNS, and complying with the laws that apply to your applications and their users.
  • Some actions change or remove things on your servers (for example deploying, restarting services, deleting a site or dropping a database). The Service asks you to confirm destructive actions; you are responsible for actions you confirm.
  • You should keep your own backups of important data. Backups made by the Service are a convenience, not a guarantee.

4. Acceptable use

You must follow our Acceptable Use Policy. We may suspend or end access for serious or repeated breaches.

5. Plans, payment and renewals

  • Paid plans are billed in advance at the price shown when you subscribe. Prices are in Nigerian naira (₦); any amount shown in another currency is an estimate.
  • If you choose a renewing subscription, your saved card is charged at the start of each billing period until you turn automatic renewal off, which you can do at any time from the billing page. Turning it off keeps your plan until the end of the period you have paid for.
  • If a renewal payment fails we will retry and notify you. If payment is not made, your team returns to the free plan after a grace period. Servers and sites over the free plan's limits are locked, not deleted: they keep running on your servers, but the Service stops managing them until you upgrade or remove some.
  • Refunds are covered by our Refund Policy.
  • We may change prices or plan features with at least 30 days' notice. Changes apply from your next billing period.

6. Your data

Your code, configuration, databases and files remain yours. You give us permission to process them only as needed to provide the Service. How we handle personal information is described in our Privacy Policy, and our Data Processing Agreement applies where we process personal data on your behalf.

7. Availability and changes

We work to keep the Service available and secure, but it is provided "as is" and "as available". Your sites run on your own servers, so they normally keep running even if the Service is unavailable. We may change, add or remove features; we will give reasonable notice of changes that materially reduce what a paid plan includes.

8. Suspension and termination

You may delete your account at any time from your account settings, after removing your servers or ending any paid plan. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service, other customers or third parties. Where reasonable we will give notice first. Ending your account does not delete anything from your servers.

9. Intellectual property

The Service, including its software, scripts, design and documentation, belongs to PFC Tek and its licensors. We grant you a limited, non-exclusive, non-transferable right to use it under these Terms. Feedback you send us may be used to improve the Service without obligation to you.

10. Disclaimers

To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that any deploy, backup, migration or security check will succeed.

11. Limitation of liability

To the fullest extent the law allows, PFC Tek is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to defend and indemnify PFC Tek against claims arising from your content, your applications, your servers, or your breach of these Terms or the law.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved in the courts of Nigeria, unless the law where you live gives you the right to bring a claim there.

14. Changes to these Terms

We may update these Terms. We will post the new version here with a new "last updated" date and, for material changes, notify account owners by email at least 14 days before they take effect. Continuing to use the Service after that means you accept the new Terms.
